Montana Advocates file OCR complaints to implement Olmstead decision

Feb. 2000 -- Advocates in Montana have filed two "class allegations" with the Region VIII Office of the U.S.Dept of Health and Human Services' -- civil rights complaints.

One charges the state of Montana with failing to develop a state plan in the wake of Olmstead. "State of Montana has not developed or implemented a written plan for moving qualified persons with disabilities to community settings," says the complaint.

You and your group can file complaints with HHS OCR regional offices, too. Here's how.

"Persons with disabilities are required to work in segregated workshops, day activity center and other day programs and are not assisted with community-based/supported employment," says the second complaint, charging the state of Montana with failing to allow people with disabilities opporutnities to work in the most integrated setting.
